This Privacy Policy describes how AutoGIN Corp. (“AutoGIN,” “we,” “us,” or “our”) collects, uses, discloses, processes, and protects information when dealerships, their employees, and authorized users (“Dealers,” “you,” or “your”) access or use the AutoGIN platform, software, websites, applications, and related services (collectively, the “Services”).

This Policy is intended to comply with applicable U.S. federal and state privacy laws, including but not limited to:

  • Virginia Consumer Data Protection Act (VCDPA)
  • California Consumer Privacy Act / CPRA (CCPA/CPRA)
  • Colorado Privacy Act (CPA)
  • Connecticut Data Privacy Act (CTDPA)
  • Utah Consumer Privacy Act (UCPA)
  • Texas Data Privacy and Security Act (TDPSA)
  • Other similar state privacy statutes
  • Applicable federal data protection and consumer protection laws


1. Roles & Scope (Critical Legal Clarification)

For purposes of U.S. privacy laws:

  • Dealers are the “Data Controllers” with respect to consumer and customer personal data entered into the AutoGIN platform.
  • AutoGIN is a “Data Processor” that processes data solely on behalf of Dealers and according to their instructions.

AutoGIN does not determine the purpose or means of processing consumer personal data collected by Dealers through the Services.

Dealers are solely responsible for:

  • Providing legally required consumer privacy notices
  • Obtaining consumer consents
  • Complying with automotive, financial, and consumer protection laws


2. Information We Collect

A. Dealer & Authorized User Information

We may collect:

  • Business name, address, phone number
  • Authorized representative name and title
  • Business email addresses
  • Login credentials and authentication data
  • Subscription, billing, and payment method details
  • Communications with AutoGIN

B. Consumer & Customer Data (Processed on Behalf of Dealers)

Dealers may input or transmit:

  • Customer names, addresses, phone numbers, emails
  • Vehicle information (VINs, trade-in data, inventory data)
  • Financial information related to vehicle transactions
  • Appointment, communication, and transaction history

AutoGIN processes this data only as instructed by the Dealer.

C. Technical & Usage Data

We automatically collect:

  • IP address
  • Device type, browser, operating system
  • Log files, access timestamps
  • Usage analytics
  • Error and performance data

D. Payment & Transaction Data

Payment information is processed through third-party payment processors. AutoGIN does not store full payment card numbers or bank credentials.



3. How We Use Information

AutoGIN uses information to:

  • Provide, operate, and maintain the Services
  • Authenticate users and manage access
  • Process subscriptions and payments
  • Provide customer support
  • Improve functionality, performance, and security
  • Detect fraud, misuse, or unauthorized access

  • Enforce contractual rights

We do not sell personal data.

5. Data Sharing & Disclosure

AutoGIN may share data with:

A. Service Providers / Subprocessors

Including but not limited to:

  • Cloud hosting providers
  • Payment processors
  • Communication providers (SMS, email)
  • Analytics and monitoring tools
  • VIN, data enrichment, aftermarket vendors, floorplan vendors or valuation providers (as configured by Dealers)

All subprocessors are contractually required to:

  • Use data only as necessary to provide services
  • Maintain appropriate security safeguards

B. Legal & Compliance Disclosures

We may disclose data if required to:

  • Comply with law, subpoena, or court order
  • Protect AutoGIN’s rights, property, or safety
  • Prevent fraud or security threats


6. Data Retention

  • Dealer account data is retained for the duration of the subscription and as required by law.
  • Consumer data is retained according to Dealer instructions or legal requirements.
  • AutoGIN may retain limited data after termination for:
    • Legal compliance
    • Dispute resolution
    • Security and fraud prevention


7. Data Security

AutoGIN implements reasonable administrative, technical, and physical safeguards, including:

  • Access controls and authentication
  • Encryption in transit
  • Monitoring and logging
  • Incident response procedures

No system is 100% secure; AutoGIN cannot guarantee absolute security.



8. Dealer Responsibilities

Dealers acknowledge and agree that they are responsible for:

  • Obtaining consumer consent
  • Providing privacy disclosures to consumers
  • Responding to consumer rights requests
  • Ensuring lawful use of the Services

AutoGIN will reasonably assist Dealers with compliance requests where required by law.



9. Consumer Rights (State Law Compliance)

Depending on state law, consumers may have rights to:

  • Access personal data
  • Correct inaccuracies
  • Delete personal data
  • Obtain data portability
  • Opt out of certain processing

Consumers must submit requests directly to the Dealer.
AutoGIN will not respond directly to consumer requests unless legally required.



10. Cookies & Tracking Technologies

AutoGIN may use cookies and similar technologies for:

  • Authentication
  • Security
  • Performance analytics
  • User preferences

Dealers may control cookies through browser settings.



11. Children’s Privacy

The Services are not intended for individuals under 18. AutoGIN does not knowingly collect data from minors.



12. Cross-State & U.S. Data Processing

All data is processed within the United States unless otherwise disclosed.
AutoGIN complies with applicable U.S. state privacy laws regardless of Dealer or consumer location.



13. Changes to This Privacy Policy

AutoGIN may update this Privacy Policy from time to time.
Material changes will be communicated through the Services or via email.

Continued use of the Services constitutes acceptance of the updated Policy.
